Arkansas Supreme Court reverses conviction of Arkansas National Guardsman

The Arkansas Supreme Court reverses the conviction of an Arkansas National Guardsman represented by The Asa Hutchinson Law Group and dismisses the underlying criminal charges against the Guardsman.  This case was the first in Arkansas history to address the Arkansas Guard’s court-martial jurisdiction.  In reaching its decision, the Supreme Court ruled that the Uniform Code of Military Justice does not apply to the activities of a Guardsman that occur when the soldier is off duty, and thus he or she is not subject to court-martial jurisdiction at the time those activities are performed.  The Firm worked with military criminal defense attorney Nathan Freeburg (www.freeburglitigation.com) on this appeal.
