Jury Awards Significant Compensation to AHLG Client in Eminent Domain Case
The Asa Hutchinson Law Group represented a landowner in an eminent domain lawsuit where the Arkansas Highway Commission condemned and acquired the client’s property in order to expand a state highway. The power of eminent domain gives the government authority to take private land for public use, but the Arkansas Constitution requires that “just compensation” be paid to the landowner.
The compensation offered by the government was substantially lower than the fair market value of the property taken. Accordingly, our client believed this amount was unjust, and so Asa Hutchinson III took the issue to trial. The jury unanimously agreed that the amount of compensation offered by the government was not just and awarded our client over $250,000 more than the government’s offer.
