In January 2024, we reported that the Arkansas Attorney General had concluded that Risever Machinery was not in violation of Arkansas law following an investigation into the company’s ownership and operations in Jonesboro.
Recent disclosures revealed in a federal lawsuit between the Arkansas Attorney General and a company the Attorney General investigated show additional context surrounding that investigation and further support the position we advanced on behalf of our client from the outset. Consequently, when allegations were initially raised regarding Risever’s compliance with Act 636, we acted immediately to review the facts and applicable law, promptly submitting a response demonstrating that the company was operating lawfully and that the allegations lacked merit.
The Attorney General’s Office subsequently confirmed our position and formally cleared Risever of any violation. Newly disclosed communications now indicate that concerns existed regarding the factual basis of the allegations during the investigation itself, reinforcing the conclusion that the claims against our client were unfounded.
Most importantly, our swift and fact-driven response allowed Risever Machinery to continue its business operations without interruption while the matter was resolved—a stark contrast to other entities targeted in the same investigation that faced severe disruptions.
The outcome remains unchanged today: Risever Machinery was cleared of wrongdoing, its operations continued uninterrupted, and the legal position we presented on its behalf was ultimately confirmed.
